The state of New York listed the Eastern Hellbender as a species of Special Concern in 1983, but that designation did not give the species legal protection. Legislation passed in late 2005 by unanimous approval of the New York State Senate and Assembly and signed by the
Governor went into affect on 2 January 2006 giving all Special Concern species protected
status. This new bill also gave the Department of Environmental Conservation the authority to
regulate the take of all native amphibians and reptiles in the state. As part of the supporting
documentation submitted with the proposed bill was the Model State Herpetofauna
Regulations developed by PARC.
