Copyright Notice/Warning in the Photo Gallery

I have just inserted a warning regarding copyright on the cover page of the Photo Gallery. Basically anyone intending to post their photo(s) in the Photo Gallery should make sure that it is marked as their own with a copyright notice. The purpose of this is to discourage would-be copiers/hijackers/thieves from using your photos around the internet without your permission and without giving any acknowledgement to you.
 
Hi John,

have knowledge how to enforce the copyright in the internet. I have at the moment a problem with someone who just plainly copied an article of me from the AG Urodela webite to his site without permission (actually quite the opposite would be true). Any suggestion?

Well you can threaten them with legal action and inform them that they're breaking the law. That usually works.
 
Depends a little bit on their location doesnt it?
Most countries have different copyright laws and there are substantial differences in how they are upholded.

Shortly: In Sweden a photo is protected from the taking to 70 years after the photographers death if the photo is seen as a work of art otherwise it is protected 70 years afters its taking. To "earn" this protection you do not have to copyright the photo neither publish your name on it, it is the copiers duty to investigate these things. It is legal to copy the photo without permission for private use, or our society's educational use or cultural use. Thus publishing a photo on a Swedish server without permission is eligible for legal action, I believe this is the case for most EU countries since Sweden changed its law in 94 due to a EU directive. I believe that in some EU-countries you still have to mark the photo as John does to "earn" this protection.
 
Uwe, do you know the person who did this? If so, you can threaten to "shame" them into removing it by exposing their crime on every caudate forum. It might be a 14-year old who wanted a cool website; he/she might not understand that this is not OK. This has happened with material from Caudate Central, and the offending people have always removed the material without too much problem. It helps if you can get SEVERAL people to e-mail them and tell them that this is wrong.
 
You should think about adding a right click disable/message script.
Right click disabling is always annoying to people who use the website and there are many ways around it, but you could put add a scare message about breaking copy write laws …
 
Thank you to your suggestions and we (as there are more people than me involved) have to think about what to do.
Unfortunately the person is a renitent one and has a history of not playing by the rules.

Dear Uwe,

I think you refer to the discussion held at the AG Urodela meeting in Gersfeld? Although the end conclusion was to ignore this person, I personally think you should try to warn him once or twice and then start a legal case. Many more people are involved, and the society (DGHT) should back-up in it. These people always get away with these things (I know a person who still holds the money of a society).
I am also one of the people who's information is still on that site without my approval.

exactly that person.
Unfortunately couldn´t reach you by e-mail. But in addition to the website name he incorparated now the Molchregister in his site without permission.

I think thats to much.

That is way out of limits, but...the DGHT to deal with it, they should seek a lawyer if a strong letter doesn't help. And I think there are enough laywers within that society.

If this person is breaking the laws why can't you tell his name and website? I think once we know his website we could start by boycotting it.

John, please do not add a "no right click" script. I use a scroll mouse, and everytime I'd try to scroll, it would result in an annoying popup. My participation here would definately decrease if such scripts were added. These scripts are so easy to get around that it's not worth the bother

I still haven't figured out how to add a small notice on my pics using either ACDSee or Photoshop. Using ACDSee, I can only get large letters and they detract from the photos. I can't even find the (c) sign! (and pasting it in won't work either)

I think you should be able to paste the copyright sign into the text editor in photoshop. Have you tried that already?
