This is really horrible.. I really feel for you and I'm sorry about Aztec. But plenty of wishes and luck to Mayan and eclipse I hope they pull through!
 
I am so disgusted that this happened and so incredibly sorry. It's obvious how much you care about your little ones.

I agree with others about taking legal action against this dip****....but if I were you I might wait until I'd had some time to recuperate from this a bit first.

Not a lawyer, but based on my very limited experience, this is small claims territory.

Don't waste money on a lawyer - file documents yourself, and small claims typically don't like lawyers
Animals = property. I know a lot of us don't agree, but such is the law currently.
Animal abuse = call police = can lead to jail time, albeit probably not in this situation.

Just don't really need a lawyer who will bill you by the hour/retainer over matters that can't lead to much "successful" revenge on the financial/criminal/civil side.
 
That is Wisdom Mike. I just read in my local paper today about animal abusers that have been convicted of felonies based on cruelty and neglect. The Sheriff's Dept. is handling it. Mike makes valid points. I wouldn't wait. Try to get as many photos as you can. Find out if it is legal to record someone in your state without them having knowledge of themselves being recorded. In some states you have to notify and some you don't. It's sounds like the little twit would hang himself just by opening his big twit mouth.

Texas is a one party consent state, but it sounds like there was NO contact made either way. He DIDN'T call, which is the issue.

Either way, small claims isn't a "beyond reasonable doubt", just "prove your case to be more believable than their defense".
 
3 Months is a long time, they were obviously neglected. No doubt you have some before pictures, get plenty of after pictures and I'd contact the ASPCA for advice. They would have seen this before and can probably tell you what to do. The important thing isn't necessarily revenge here, but to stop this from happening to another person's pets!
 
Your poor babies! I can't imagine coming home to that! I'm no kind of expert on this kind of emergency care but it sounds like you're doing everything they need. I have every confidence that you're giving them the ideal environment for recovery.

As for the guy - try contacting the non-emergency police number or your local animal shelters for advice on who to report him to or how to pursue legal action. Heck, contact a petsitting agency and ask them for advice! They can only benefit from keeping this guy out of business, and they're most likely to know what kind of legal action could be taken in this exact scenario since they have to defend themselves from it. My uncle is a lawyer only reason I was talking to one... I lost Eclipse tonight. My heart is completely broken, I can NOT lose Mayan too, I'm a wreck.

Take pictures. Call the guy and record him. This not revenge, but justice.
 
Okay false alarm. Last night I went ahead and still did a water change on her tank and added air bubblers to both tanks and today she's back upright and alive? Oh and Mayan ate a feeder guppy, not the best but I was desprate!
 
Thank goodness! I'm so glad Eclipse is better!

I really hope you get justice for your babies. I'm just glad he didn't neglect your dogs too. Sending hope and wishes your way.

They are home bred, the Axies RARELY get them, but I was desprate. Good news is I have Mayan eating again, worms that is. And Eclipse snapped at food a tiny bit, won't eat yet, but she awknowledged food rather then just trying to get away from it.
 
It's good to hear that the poor things are turning around, at least. Take pictures of your dirty tank too, if you haven't already. If keeping it clean was part of his job, then he can pay for any damages that may have been done to filters etc. Get this little bast@rd for all he's worth.

Were your other dogs ok?
 
My house smells of pee, the dogs all act like they haven't been exersized. One has an infected nail where it split and wasn't cleaned or treated. I had a contract with the guy. Lawyer IS involved at least to get me through claims court, bastard is going down.
 
Quick update, Mayan is eating pretty normally now, and Eclipse is still kicking and active, she's eaten a few pellets, no worms yet... but hey she ATE!!!

Also acquired 2 larger girls yesterday in a random turn of events, both healthy and around 8". They are in their own tank obviously, but I do hope to ONE DAY be able to put all 4 in my empty 110 gallon :)

But as of right now everyone is alive and working on recovery!
 
That's good news at least! I would take pictures of EVERYTHING. Keep records of vet bills in the event that you have to take your dog in to get its nail looked at, document everything you possibly can.
 
Glad to hear Eclipse is fine! Best wishes to both of your axies, and welcome home to the new ones! I hope everything goes alright for you. Like everyone's been saying, keep a good record. Make sure you save any bills for damaged equipment, get a black light maybe to take pictures of pee where your dogs where neglected, snap some of the toenail and anything else. Its just so horrible this happened to you, I have to worry if the same guy has done it to others.
 
So both your babies are on the road to recovery? That's great! If Eclipse is eating pellets there's a good chance she may eat what she normally does. I think she was probably just stressed and a bit run down with all that happened.

Did you add your driftwood to the tank in the end? How are they all looking now?
